General

Why do we collect your personal information

To create your membership account.
To process your purchase of our products, this includes purchases made with a registered Earth & Me account or a guest account. For a guest account, this information is collected solely for the purpose of processing the purchase transaction and fulfilling the order.
To administer and/or manage your relationship with Earth & Me.
To process your enquiries through our e-commerce page.
To communicate service-related announcements, recommendations, offers and other updates or promotions.
To recover any and all amounts owed to Earth & Me.
To secure and/or verify in preventing, detecting and investigating fraud, misconduct, any unlawful action or omission, whether relating to your application or any other matter relating to your account(s), and whether or not there is any suspicion of the aforementioned.
To manage Earth & Me’s infrastructure and business operations, and comply with the policies and procedures that may be required by law or that may have been put in place by Earth & Me, including those relating to auditing, finance and accounting, billing and collections IT systems, data and website hosting, training, testing, business continuity, and records, document and print management.
To administer our customer rewards program and provide rewards to customers.
To administer and provide you with activities such as contests, lucky draws, campaigns, promotions, events, surveys or questionnaires, if consented by you via your registration and/or participation in any of the activities stated. How do we collect your personal information?

We may collect a variety of your Personal Information when you register and create an account with Earth & Me or when you make a purchase without a registered member account/guest account, including but not limited to the following:

- Gender;
- Date of Birth;
- Postal Address;
- Telephone Number (home, mobile, office);
- Email Address;
We may request certain Personal Information about customers’ babies for our customer rewards programme, such as;
- Full Name;
- Gender;
- Date of Birth;
This information is collected solely for the purpose of administering the reward program and providing rewards to customers.
At any point during your use of our Services, Earth & Me will automatically collect data from you, in order to improve the quality of the Services and customise the user experience, including but not limited to the following;
- Log Information – include things like your IP address, browser or device configuration, date and time of access.
- Cookies – a small text file that is stored on your computer that provides us with information about your online use of our website.

How do we use your personal information?

Earth & Me may also be required to disclose your personal information to third parties who will then process your personal information for one or more of the aforementioned General purposes. You hereby acknowledge and agree that Earth & Me may disclose your personal information to the following third parties;Earth & Me’s affiliates, business partners, or related companies, as well as the relationships between them.
Earth & Me may share information with third-party service providers who provide services to us. These services may include, among other things, assisting us in providing requested services, creating or maintaining our databases, researching and analysing people who request products, services, or information from us, preparing and distributing communications, or responding to inquiries.
Earth & Me will not disclose customers’ babies’ personal information to third parties, except as necessary to administer the reward program, such as to our reward programme partners and suppliers. Personal information may also be disclosed to comply with applicable laws, regulations, or court orders.
Earth & Me may decide to make it possible for users to share comments, postings, testimonials (including ratings or reviews), or other information. If you choose to submit such information to us, the information you provide may become generally available to the public. Others who access these areas may read, collect, and use the information you provide in these areas.
Earth & Me may report to law enforcement agencies any activities that we reasonably believe are illegal or that may aid a law enforcement investigation into illegal activity. Furthermore, we reserve the right to disclose your information to law enforcement agencies if we determine, in our sole discretion, that you have violated our policies or that disclosing your information is necessary to protect the rights, property, or safety of Earth & Me or another person.
Earth & Me may disclose your information to others if required or permitted by law. This may include disclosing your information to government entities or third parties in response to subpoenas, court orders, or other legal processes, or as we believe is necessary to exercise our legal rights, defend against legal claims brought against us, or defend against possible legal claims brought against us in our sole discretion.
Earth & Me may transfer your personal information to data storage facilities or servers located outside Malaysia, or to affiliates or trusted third parties based outside Malaysia so that they can process personal information on our behalf and we can carry out your requests and use the personal information for the purpose for which it was collected.

Rights of Users

To the extent that the applicable law allows, you shall:-

have access to your personal information held by Earth & Me and may request that it be corrected if the data is inaccurate, incomplete, misleading, or out of date by accessing the customer dashboard and editing their profile.
According to the PDPA 2010, you have the right to withdraw your consent at any time by giving Earth & Me written notice; however, depending on the circumstances and nature/extent of your withdrawal, your withdrawal of consent may result in Earth & Me’s inability to provide you with the services and products.
You acknowledge that, in accordance with local personal information protection laws, some personal information may be exempt from such access and correction rights.
You have the right to access, correct, or delete your babies’ personal information at any time.

Security

Earth & Me guarantees that your personal information will be used solely for the intended General purposes and that the disclosure of your Personal Data will be strictly on a need-to-know basis to its employees or directors, or any authorised third party as mentioned in the Disclosure Clause above.
Earth & Me guarantees that your baby’s personal information will be used solely for the intended General purposes and that the disclosure of your baby’s personal information will be strictly on a need-to-know basis to its employees or directors, or any authorised third party as mentioned in the Disclosure Clause above.

Retention

Your personal information will not be kept for any longer than is necessary to fulfil the stated purposes and will be destroyed/permanently deleted if it is no longer required for the purpose for which it was to be processed, subject to Earth & Me’s legal or regulatory requirements.
We keep personal information about our customers’ babies only as long as it is required to administer the reward programme or as required by applicable laws and regulations. When we no longer need the information, we securely dispose of it in accordance with our data retention policies.

Miscellaneous

To avoid doubt, if Malaysia’s personal information protection law allows an organisation such as Earth & Me to collect, use, or disclose your personal information without your consent, the law’s permission will continue to apply.

Changes to Our Privacy Policy

You acknowledge that Earth & Me reserves the right, at its sole discretion, to withdraw, amend, omit, and/or vary any part or the entire Privacy Policy at any time.
You should check our website on a regular basis for changes to our Privacy Policy. The current amended and modified Privacy Policy will be posted on our website and will supersede all previous versions.
